Impaired Driving charges are different from Over 80 charges in that the Crown in the first case is obligated to prove that one’s ability to operate a motor vehicle is impaired and in the latter that the alcohol concentration was in excess of 80 milligrams of alcohol in 100 milliliters of blood.
